Welcome to West Point, located at westpoint.digital. These Terms and Conditions govern your access to our website and the standard contractual agreements for video production services provided by our agency.

1. Definitions

• "Company"/"Studio": West Point (westpoint.digital), with primary email contact via [email protected].
• "Client": The individual, business, or agency commissioning video or film production.
• "Deliverables": Final polished 4K/8K video files, edited assets, sound stems, or color files delivered.

2. General Website Use

By using our website, you warrant that you are at least 18 years of age and will not use our platform or online contact forms for any unlawful, fraudulent, or abusive marketing actions.

3. Project Estimates & Booking

Any project cost estimates provided via email, phone, or our online quote tool are valid for 30 calendar days. Filming bookings are only officially confirmed upon the execution of our comprehensive Production Agreement and the receipt of the initial deposit payment (typically 50%).

4. Intellectual Property Rights

Unless outlined differently in our master Production Agreement, West Point retains ownership over all raw behind-the-scenes footage, project project files, and unrendered raw camera assets. Full distribution and broadcasting rights of the final rendered files are transferred to the Client upon receipt of full and final project payment.

5. Indemnification & Limitation of Liability

West Point will not be held liable for delayed project execution stemming from weather conditions, technical crew emergencies, actor cancellations, or municipal permit delays beyond our immediate control (Force Majeure).

6. Governing Law

These terms and conditions are governed by and construed under the laws of South Africa. Any legal disputes or claims arising out of our work will fall under the exclusive jurisdiction of the competent courts in Johannesburg.
